By accessing or using our Services, you represent that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference.
To access certain features of our Services, you may be required to create a user account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately if you suspect any unauthorized access to or use of your account.
(a) Ownership and Rights: You may submit input to the Services ("Input") and receive output generated by the Services based on the Input ("Output"). Input and Output are collectively referred to as "Content." Subject to applicable law, you retain all proprietary rights, title, and interest in and to the Input. In accordance with these Terms and contingent upon your compliance therewith, AIPLUX hereby assigns to you all right, title, and interest in and to the Output. Consequently, you are permitted to use the Content for any lawful purpose, including commercial exploitation such as sale or publication, provided that you adhere to these Terms. AIPLUX may utilize the Content to deliver and maintain the Services, abide by applicable laws, and enforce its policies. You shall be responsible for the Content, including ensuring its compliance with all applicable laws and these Terms.
(b) Similarity of Content: Owing to the inherent nature of machine learning, Output may not be unique to individual users, and the Services may generate identical or similar output for AIPLUX or third parties.
(c) Content Usage for Service Improvement: AIPLUX will not use Content to develop or enhance the Services.
(d) Accuracy of Content: As artificial intelligence and machine learning are rapidly evolving domains, we continually strive to refine our Services to ensure greater accuracy, reliability, safety, and utility. However, due to the probabilistic nature of machine learning, our Services may occasionally generate inaccurate Output that does not faithfully represent real people, places, or facts. As such, you are advised to assess the veracity of any Output in accordance with the requirements of your use case, which may include employing human review of the Output.
You agree not to use our Services to:
a. Upload, transmit, or distribute any content that is unlawful, defamatory, harassing, abusive, fraudulent, obscene, or otherwise objectionable.
b. Upload, transmit, or distribute any content that infringes or violates any intellectual property, privacy, or other rights of any third party.
c. Interfere with or disrupt the operation of our Services or the networks connected to our Services.
d. Access, tamper with, or use non-public areas of our Services, our computer systems, or the technical delivery systems of our providers.
e. Attempt to probe, scan, or test the vulnerability of any AIPLUX system or network, or to breach any security or authentication measures.
f. Violate any applicable law or regulation.
We may suspend or terminate your access to our Services at any time, without prior notice or liability, if we believe that you have violated these Terms or for any other reason.
Our Services are provided on an "as is" and "as available" basis, without any warranties of any kind, express or implied. AIPLUX disclaims all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
In no event shall AIPLUX, its affiliates, or their respective officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use our Services; (b) any conduct or content of any third party on our Services; or (c) any unauthorized access, use, or alteration of your User Content.
